3. Consultation Bookings

3.1 The Website may allow you to request or book consultations with HR Navigator (Booking). A Booking submitted through the Website is a request only and does not create a binding engagement until confirmed by HR Navigator.

3.2 HR Navigator reserves the right to accept, decline, or reschedule any Booking at its discretion.

3.3 When submitting a Booking, you must provide accurate and complete information. You are responsible for ensuring that your contact details are current so we can communicate with you about your Booking.

3.4 Any consultation booked through the Website is subject to these Terms.

4. Forms and Information Submitted by You

4.1 The Website may include contact forms, enquiry forms, intake questionnaires, or similar tools that allow you to submit information to HR Navigator (Forms).

4.2 By submitting information through a Form, you:

confirm that all information you provide is accurate, complete, and not misleading;
consent to HR Navigator collecting, storing, and using that information in accordance with our Privacy Policy; and
acknowledge that submitting a Form does not create a client relationship, retainer, or engagement with HR Navigator unless and until a separate Services Agreement is executed.

4.3 HR Navigator will use reasonable efforts to respond to Form submissions promptly but does not guarantee a response within any particular timeframe.

5. Website Content and Disclaimers

9.3 Where HR Navigator’s liability cannot be excluded under clause 9.2, our total aggregate liability to you for all claims arising out of or in connection with the Website is limited to the lesser of:

$500 (AUD); or
the fees actually paid by you to HR Navigator in the 3 months preceding the event, giving rise to the claim.

10.Indemnity

10.1 You agree to indemnify, defend, and hold harmless HR Navigator, its directors, officers, employees, agents, and contractors from and against any and all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

your use of the Website in breach of these Terms;
any information or content you submit through the Website;
your violation of any applicable law or regulation; or
your infringement of any third-party rights.

11.Governing Law and Jurisdiction

11.1 These Terms are governed by the laws of Western Australia.

11.2 You irrevocably submit to the exclusive jurisdiction of the courts of Western Australia and any courts of appeal from them for the resolution of any dispute arising out of or in connection with these Terms.

12.Severability

12.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed to the minimum extent necessary and the remaining provisions will continue in full force and effect.

13.1 These Terms, together with the Privacy Policy, constitute the entire agreement between you and HR Navigator in relation to your use of the Website and supersede all prior or contemporaneous communications, proposals, and representations with respect to the Website.

14.Waiver

14.1 A failure by HR Navigator to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision. Any waiver must be in writing and signed by HR Navigator.
